Terms of Use

This Website is the property of Arcitura Education Inc. (“Arcitura”). These Terms and Conditions (the “Terms”) apply to the website located at http://es.arcitura.com/store/, and all associated websites developed or published by Arcitura, its subsidiaries and affiliates (the “Website”). By using the Website, you agree to these Terms. Arcitura may, at its sole discretion, change, modify, add or remove portions of these Terms, at any time, and it is your responsibility to check these Terms periodically for changes. Your continued use of the Website will mean that you accept and agree to changes to the Terms, as same may apply from time to time.

Customs Fees

Hard copy study kits and other printed item(s) that are ordered are shipped from Canada. Additional customs charges may apply, depending on the shipment destination. These are not shipping fees; they are charged by the government customs office of the destination country. UPS may act as the customs broker, in which case the UPS carrier may collect custom fees on behalf the customs office upon delivery.

Currency

All orders are charged in USD currency.

Returns and Refunds

Hard copy study kits can be returned for a full refund within 14 days of purchase. Hard copy study kits need to be returned in their original condition for a refund to be issued. Shipping costs to return these study kits are incurred by customer. Unredeemed exam vouchers can be returned for a full refund within 48 hours of purchase. eLearning study kit subscriptions and other eLearning products are not eligible for a refund but can be cancelled for store credit within 24 hours of purchase. Arcitura reserves the right to refuse further sales of products or subscriptions to customers who request a refund more than once. For any purchase made by credit card, the refund amount can only be issued to the originally used credit card. For any purchase made via PayPal, the refund amount can only be issued to the originally used PayPal account.

Voucher Expiry

Pearson VUE exam vouchers are valid for one year from the date of purchase and can be renewed for an additional year upon request.

Promotional Codes and Discounts

An Arcitura promotional discount or coupon code may only be able to be applied once to an order and may not be combined with other discounts or coupon codes. Arcitura promotional discounts and coupon codes may be subject to additional terms and conditions and can be canceled or voided at any time.

eLearning Subscription Access and Usage Policy

Each subscription to an Arcitura eLearning study kit, online video course or any other eLearning product sold or issued by Arcitura can only be accessed and used by the individual or organization to which it has been explicitly licensed, unless indicated otherwise in writing by Arcitura Education. All eLearning product content is protected by copyright. Individuals and organizations that purchase or receive a subscription to such content are prohibited from downloading, copying or otherwise capturing or sharing the documents and information presented by the eLearning product being accessed.

Accounts

Certain services provided through the Website may require you to open an account. It is your sole responsibility to maintain the confidentiality of the information you hold for your account, including your password, and you are responsible for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You may be held liable for losses incurred by Arcitura or any other user of or visitor to the Website due to someone else using your account. You agree to notify Arcitura immediately of any unauthorized use of your account or password, or any other breach of security.

Privacy

Privacy Arcitura’s Privacy Policy applies to use of this Website, and its terms are made a part of these Terms by this reference. Additionally, by using the Website, you acknowledge and agree that Internet transmissions are never completely private or secure and understand that any message or information you send to the Website may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

Disclaimer of Warranty

The Website and products and services offered thereon are provided on an “as is” and “as available” basis and Arcitura provides no warranties or conditions, express or implied, including without limitation, those of merchantability, fitness for a particular purpose, satisfactory quality, title, or non-infringement of third party rights. Arcitura does not represent that the Website, products or services will meet your requirements. You assume all responsibility for determining whether the products and services are sufficient for your purposes and no written or oral representation by Arcitura shall create a warranty in the Website, product or service. Arcitura does not represent that your use of the Website will be secure, timely, uninterrupted or error-free, or that the Website, product, service, documentation and/or overall system that makes them available (including but not limited to the internet, other transmission networks, and customer’s local network and equipment) will be free of errors or that such errors will be corrected. All information provided on the Website is subject to change without notice. You assume total responsibility for your use of the Website and Arcitura cannot ensure that any files or other data you download from the Website will be free of viruses or contamination or destructive features.

Limitations of Liability

Your sole remedy for dissatisfaction with the Website or any content is to stop using the Website or any content contained thereon. This limitation of relief is a part of the bargain between the parties. The maximum liability of Arcitura arising out of or in connection with use of the product or services, whether such liability arises from any claim based on breach or repudiation of contract, breach of warranty, negligence, tort, statutory duty, or otherwise, shall be an amount equal to the total fees paid by you to Arcitura for the product or services. Notwithstanding the foregoing, Arcitura shall not be liable to any person to the extent such liability would not have occurred but for the failure to comply with the terms governing the Website, product or services, or failure to mitigate damages. To the maximum extent permitted by law, in no event shall Arcitura be liable to anyone for lost profits or revenue or for incidental, consequential, punitive, cover, special, reliance or exemplary damages, or indirect damages of any type or kind however caused, whether from breach of warranty, breach or repudiation of contract, negligence, or any other legal cause of action from or in connection with the Website, product or services (and whether or not Arcitura has been advised of the possibility of such damages).

Indemnity

You agree to indemnify and hold Arcitura, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Arcitura by any person due to or arising out of or in connection with your use of the Website.

Governing Law

You agree that all matters relating to your access to or use of the Website, including all disputes, will be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein and you agree to submit to the jurisdiction of the courts of British Columbia with respect to any legal proceedings arising therefrom.

 

Arcitura Education reserves the right to change the above terms and policies without notification to customers. The customer and Arcitura Education agree that these terms and policies fall under the legal jurisdiction of British Columbia, Canada.
